Individual reactions to essential oils, fragrance blends, herbs, cosmetics, bath products, topical products, and similar items may vary.

Products may be selected, described, marketed, used, or created in connection with particular intentions, spiritual traditions, symbolic meanings, energetic concepts, or planetary associations. SAFETY INFORMATION: Do not ingest essential oils unless a product is expressly intended for internal consumption and such use is appropriate under the guidance of a qualified professional.

WAIVER OF CLASS ACTIONS: To the fullest extent permitted by law, you and Sacred Energy Empowerment Center agree to assert covered Claims only in an individual capacity and not as a representative or member of a purported class, mass, collective, consolidated, private attorney general, or other representative proceeding.

To the extent permitted by law, an arbitrator will not consolidate Claims belonging to multiple unrelated persons or conduct a class-wide arbitration unless both parties expressly agree or applicable law requires otherwise.

WAIVER OF JURY TRIAL: For Claims properly subject to binding arbitration, each party waives the right to have those Claims decided by a judge or jury in court.

OPT-OUT: You may opt out of this Arbitration Agreement by sending Sacred Energy Empowerment Center a signed written opt-out notice within thirty (30) days after the date you first become subject to this Arbitration Agreement.

SMALL CLAIMS ARE NOT SUBJECT TO ARBITRATION: Either party may bring an eligible individual Claim in an appropriate small claims court.

ARBITRATION PROCEDURES: Either party may initiate arbitration in accordance with the procedures of the applicable arbitration provider. Unless otherwise agreed, arbitration will be conducted by a single neutral arbitrator.

ARBITRATION PROVIDER: Arbitration may be administered by JAMS or another nationally recognized alternative dispute-resolution provider mutually agreed upon by the parties. If the selected provider is unavailable or unwilling to administer the dispute, the parties may agree to another provider or seek appointment of an arbitrator as permitted by applicable law.

ARBITRATION RULES: Unless otherwise required by law or agreed by the parties, arbitration administered by JAMS will be conducted under the applicable JAMS consumer or streamlined arbitration rules appropriate to the dispute.

The arbitration provider’s rules will govern procedural matters except where they conflict with a valid provision of this Arbitration Agreement or applicable law.

ARBITRATION LOCATION: Unless applicable law requires otherwise, an in-person arbitration hearing involving Sacred Energy Empowerment Center will take place in Salt Lake County, Utah, or another location mutually agreed upon by the parties or determined by the arbitrator in accordance with applicable arbitration rules.

Where permitted, proceedings may be conducted by telephone, videoconference, written submissions, or another remote method.

FEES: Filing, administrative, hearing, and arbitrator fees will be allocated in accordance with applicable arbitration rules and applicable law.

ARBITRATOR’S AUTHORITY AND AWARD: The arbitrator will determine the rights and liabilities of the parties concerning the Claim submitted to arbitration. Subject to applicable law and arbitration rules, the arbitrator may award monetary damages and individual non-monetary relief otherwise available in a court of competent jurisdiction.

An arbitration award may be confirmed or enforced in a court having jurisdiction.

GOVERNING ARBITRATION LAW: To the extent applicable, the Federal Arbitration Act and federal arbitration law will govern interpretation and enforcement of this Arbitration Agreement.

CONFIDENTIALITY: Arbitration proceedings will be treated as confidential to the extent permitted by applicable law and applicable arbitration rules. Nothing in this provision prevents disclosures required by law or disclosures reasonably necessary to enforce the Arbitration Agreement or an arbitration award.

If a provision of these Terms is determined by a court, arbitrator, or other tribunal of competent jurisdiction to be unlawful, invalid, or unenforceable, the provision will, where legally permissible, be interpreted or modified to the minimum extent necessary to accomplish its intended purpose while remaining enforceable.

If modification is not possible, the affected provision will be severed and the remaining provisions of these Terms will remain in full force and effect.

Except to the extent federal law or another law that cannot validly be waived or displaced applies, these Terms will be governed by and construed in accordance with the laws of the State of Utah without giving effect to conflicts-of-law principles that would require application of another jurisdiction’s laws.

For disputes that are not subject to the Arbitration Agreement and that may lawfully be subject to a forum-selection provision, you and Sacred Energy Empowerment Center consent to the jurisdiction and venue of appropriate state or federal courts located in Salt Lake County, Utah.

These Terms, together with our Privacy Policy and any additional policies, purchase terms, registration agreements, membership agreements, event agreements, class agreements, or other terms expressly incorporated by reference, constitute the agreement between you and Sacred Energy Empowerment Center concerning your use of our website and the matters addressed by those documents.

To the extent permitted by applicable law, these Terms supersede prior communications, negotiations, representations, or agreements concerning the same subject matter except for separate written agreements expressly intended to remain in effect.

Sacred Energy Empowerment Center will not be liable for failure or delay in performance caused by events beyond its reasonable control, including acts or omissions of third parties, supply shortages, equipment failures, utility interruptions, Internet or telecommunications failures, war, terrorism, civil unrest, labor disputes, strikes, lockouts, fire, flood, earthquake, severe weather, natural disasters, epidemics, pandemics, governmental orders, laws, regulations, court orders, transportation interruptions, or other force majeure events.

Access to our website does not, by itself, constitute Sacred Energy Empowerment Center’s purposeful availment of the laws or jurisdiction of every location from which a user may access our website.
